Terms and conditions

1. Object

1.1 These General Conditions, updated in March2021, the offer of the Online Store Service of Herdade Barranco do Vale, with its head office at Rua Doutor Manuel Maria Corrêa Guerra Nº5, Paredes 2580-355 Alenquer with tax identification number No.  514901330, hereinafter referred to as Herdade Barranco do Vale, will be governed.

1.2 The purchase of any product in the Herdade Barranco do Vale Online Store implies acceptance of these General Conditions of Sale Online.

1.3 Any and all alcoholic beverages available for sale in the Herdade Barranco do Vale Online Store may only be purchased by persons of legal age to do so, in the light of the applicable rules in Portugal and the country of residence.

2. Product Information, Prices and Content

2.1 Herdade Barranco do Vale reserves the right to modify, without notice and at any time, the information and commercial offer presented about: products, prices, promotions, commercial conditions and services.

2.2 The images illustrating each product in the Herdade Barranco do Vale may differ from the product subsequently delivered, and these same products are also subject to stock rupture.

2.3 Under Portuguese law, all prices presented in The Barranco do Vale Estate include their VAT rates in force, unless otherwise stated.

3. Order and Payment

3.1 After the confirmation of the order in the Herdade Barranco do Vale, an e-mail will be sent to the contact address registered thereby the customer at the time of formalization, with all the details about delivery, billing, payment information, products and values.

Herdade Barranco do Vale suggests to all customers the confirmation of its details. If the customer does not receive the order confirmation email, he/she is asked to contact Herdade Barranco do Vale through the contacts so that this notification is sent back to the customer’s email address.

3.2 If any of the details placed by the customer in the order are mistaken and/or the customer wishes to change any information, provided that the order has not yet been shipped, the customer is asked to contact the following contacts as soon as possible so that the change requested by the customer is made internally.

3.3 All orders in Herdade Barranco do Vale will only be processed after the actual receipt of payment. The formalization of the order itself does not constitute a reservation of the products.

3.4 If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by Herdade Barranco do Vale in order to find the most appropriate solution.

3.5 All orders placed at Herdade Barranco do Vale have a maximum payment period of 72hours. At the end of this period, the order will be automatically cancelled.

3.6 Orders may be cancelled when expressly requested by the customer through one of the following contacts before orders are shipped.

After confirming the shipment of the order, the customer is asked to contact Herdade Barranco do Vale to jointly find the most appropriate solution.

3.7 Through the Herdade Barranco do Vale Online Store payments are accepted through MBWAY (For customers with bank account in Portugal), Bank Transfer, payment against withdrawal at herdade Barranco do Vale’s facilities.

3.8 The order states at Herdade Barranco do Vale are comprised of 4 phases: Pending, In Hold and Finalized Processing.

a) Pending – Awaits the entry of payment in the system of Herdade Barranco do Vale;

b) In Processing – Phase in which the payment has already been received, and the order is in processing and packaging/preparation;

c) Waiting – Awaits further confirmations with the customer to proceed with the order. Exceptional phase.

d) Finalized – The order has already been shipped/shipped.

3.9 Payments are received in euro, regardless of the currency in which the transaction is made, the conversion fees of payments made in other currencies must be borne by the customer.

4. Shipping costs

4.1 The prices shown in the products are added the respective value of the postage. The shipping cost depends on the quantity of the order and its delivery destination. The value of the postage can be simulated inside the shopping cart with the added products, filling in all the requested fields. The total postage will be automatically calculated when you place your order in the Online Store. It should be noted that the factors of this calculation may be variable and undergo changes without notice.

5. Shipments and Deliveries / Survey in Physical Store HERDADE BARRANCO DO VALE

5.1 For orders to be sent to the requested address must be National Shipping (in case of Portugal) and International Shipping (in case of other countries outside Portugal).

5.2 In general, after shipment, an order will be delivered:

– 72 hours in Mainland Portugal;
– Between 5 and 9 working days in the Islands of Madeira and Azores;
– About 4 working days in Peninsular Spain;
– About 6 working days in the rest of Europe;
– Approximately 7 to 15 business days in the rest of the world.

5.3 After the shipment of orders, the information for the message of the shipment will be available in the account of customers who have placed the order with registration and is also sent a notification via e-mail with the information of the link for the message to monotorization of the shipment to all registered and unregistered customers. If for any reason the customer does not receive the shipping confirmation, he/she should contact Herdade Barranco do Vale through one of the following contacts in order to send back all available information about the shipment of the order.

5.4 After the notification of shipment, customers will be able to monitor the status of the shipment through the link (tracking number) provided by Herdade Barranco do Vale so that they are aware of the state of evolution until the time of delivery of the order.

5.5 All products shipped by Herdade Barranco do Vale must be checked at the time of delivery. If the customer finds that the order is damaged, he/she must return it immediately to the transport company, duly justify the reason for the return on the carrier’s consignment slip and immediately notify Herdade Barranco do Vale through one of the following contacts.

5.6 If after delivery, the customer verifies that any of the items are not in conformity, he is asked to contact Herdade Barranco do Vale immediately through the e-mail geral@hvb.pt indicating the order number or the document number that accompanied the order, attaching images of the packaging as received and allitems, so that internally the process of investigating the occurrence is opened and thus the situation can be resolved as soon as possible.

5.7 Herdade Barranco do Vale is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. It is the responsibility of the customers to be able to seize their orders, as well as the payment of customs fees, if any. In case of return of the products, Herdade Barranco do Vale will refund only the respective amount to these same products. In case of doubt the customer can contact Herdade Barranco do Vale before ordering.

5.8 Herdade Barranco do Vale has contracted specialized transportation services for deliveries in Portugal, Europe and most countries in the world. However, it should be noted that the possible delays in deliveries may be of a nature unrelated to herdade Barranco do Vale, and it is not possible, in these cases, to guarantee exact delivery times.

5.9 Most deliveries are made during business hours on working days at the shipping address indicated by the customer when submitting the order.

5.10 In the event of an unsuccessful delivery attempt by the transport company by absence, a notice of passage shall always be left in the customer’s mailbox with the carrier’s instructions. Depending on the service and the carrier the orders must be collected at the place indicated by the same in the notice of passage, or the indications requested in the same notice should be followed.

5.11 If for any reason the customer cannot receive the order or pick it up at the place indicated by the carrier, the customer is asked to contact Herdade Barranco do Vale so that together the most appropriate solution can be found.

5.12 Before submitting the order, if the customer intends to pick up the order at Herdade Barranco do Vale, he/she must select the shipping option “Store Pick-up.”

a) It will only be authorized to pick up the order the person whose name is described in the purchase order, unless it communicates in advance to Herdade Barranco do Vale that another person (identifying the name) will pick up the order.

b) Orders for pick-up in store may take 1 business day to be processed, all customers are notified via e-mail when they are available to be collected.

c) When addressing the physical facilities of Herdade Barranco do Vale, in Estrada Municipal 510, Sítio de Campilhos, 8375-021 São Bartolomeu de Messines, the customer should follow the confirmation / order number, ensuring that he received our notification of order confirmation available for withdrawal, and thus avoid unnecessary travel.

6. Applicable Law

6.1 Herdade Barranco do Vale recognizes to all its customers the right to resolve the contracts they enter into with it, allowing them to return, within 14 (fourteen) days, the products purchased under Decree-Law No. 143/2001 and Decree-Law 82/2008 of 20/05.

6.2 For exchanges or returns, the customer is requested to contact Herdade Barranco do Vale via e-mail geral@hbv.pt indicating the number of the order or document thataccompanied it, taking into account the conditions described below in the following topics:

a) To return the order, the product must be in perfect condition, and if applicable with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.

b) The return of defective products and wrong shipments will be accepted, and Herdade Barranco do Vale is responsible for the costs of sending and collecting whenever the customer communicates this circumstance within 1 week (7 days) days from the date of receipt of the product.

c) Once the goods have been received at our facilities and after validation of the condition of the same accordingly, the return of its value will be made according to the payment method made by the customer, or another solution previously agreed with the same.

6.3 Herdade Barranco do Vale assumes responsibility arising from the defects of origin or raw material of the purchased product and if this is confirmed by the specialized team of Herdade Barranco do Vale will proceed to exchange or return the product at no cost to the customer.

6.4 Herdade Barranco do Vale will not accept the return of the product after use, or in the event that it has been changed or modified.

6.5 Herdade Barranco do Vale is not responsible for deficiencies arising from incorrect use, negligence, poor storage conditions or causes of force greater force.

7. Applicable Law

7.1 All purchases made on the website of Herdade Barranco do Vale are subject to Portuguese law. Any conflict or divergence of interpretation of the General Conditions of Sale Online will be submitted to the Portuguese court.

7.2 If the Client is outside mainland Portugal, Herdade Barranco do Vale informs you at the outset that any legal proceedings must be exclusively brought before the Portuguese Courts.

These general conditions of sale online may be changed without notice and must therefore be consulted before placing any order.
